Art. 4 Before conclusion of the contract

1 The organiser or the retailer must communicate all the terms and conditions of the contract to the consumer in writing before the contract is concluded. 2 The terms of the contract may also be brought to the consumer’s attention in another appropriate form, provided that they are confirmed to him in writing before the contract is concluded. The obligation to confirm in writing does not apply if compliance would prevent the conclusion of the contract. 3 Where it is relevant for the package, the organiser or the retailer shall provide the consumer, in writing or any other appropriate form, with general information on: a. passport and visa requirements applicable to nationals of the states of the EC and the EFTA, and in particular on the periods for obtaining them; b. health formalities required for the journey and the stay. 4 Nationals of any other states are entitled to such information according to paragraph 3 letter a above, if they request the same immediately.

Art. 5 Before the start of the journey

The organiser or retailer shall provide the consumer, in writing or any other appropriate form, with the following information in good time before the start of the journey: a. the times and places of intermediate stops and transport connections; b. the seat to be occupied by the traveller; c. the name, address and telephone number of the organiser’s or retailer’s local representative or, failing that, of local agencies on whose assistance a consumer in difficulty could call; where even no such agencies exist, the consumer must in any case be provided with an emergency telephone number or any other information that will enable him to contact the organiser or the retailer; d. in the case of journeys or stays abroad by minors, information enabling direct contact to be established with the child or the person responsible at the child’s place of stay; e. information on the optional conclusion of an insurance policy to cover the cost of cancellation by the consumer or the cost of assistance,
