Art. 1 Package travel

1 Package travel means the pre-arranged combination of not fewer than two of the following when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four hours or includes overnight accommodation: a. transport; b. accommodation; c. other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package. 2 This Act also applies if various components of the same package have been billed separately.

Art. 2 Organiser, Retailer and Consumer

1 Organiser means any person who, other than occasionally, organises packages and sells or offers them for sale, whether directly or through a retailer. 2 Retailer means any person who sells or offers for sale the package put together by the organiser. 3 Consumer means: a. any person who takes or agrees to take a package; b. any person on whose behalf or for whose benefit a package has been purchased or an agreement to purchase has been entered into; c. any person to whom the booking relating to a package tour has been transferred in accordance with article 17.
