Ordinance on Biocidal Products (OBP)

Art. 31 Placing on the market
1 A treated article shall not be placed on the market unless all active substances contained in the biocidal products that it was treated with or incorporates: a. are listed in Annex 2 for the relevant product type and use, or in Annex 1, and any conditions or restrictions specified therein are met; or b. are employed in a biocidal product granted authorisation AnL for the relevant use. 2 Active substances in a biocidal product in accordance with paragraph 1 letter b must be appropriately included in the list specified in Article 9 paragraph 5. 3 Paragraph 1 does not apply to treated articles where the sole treatment undertaken was the fumigation or disinfection of premises or containers used for storage or transport and where no residues are expected to remain from such treatment.

Art. 31a Labelling
1 Anyone who is responsible for the placing on the market of treated articles must: a. label them in accordance with Article 58 paragraphs 3, 4 and 6 of Regulation (EU) No 528/2012; and b. include in the instructions for use the relevant information specified in the ORRChem. 2 The labelling must be in at least one official language of the place where the treated article is placed on the market.

Art. 31b Additional obligations
1 Anyone who is responsible for the placing on the market of treated articles must, on request, provide consumers with information on the biocidal treatment of the treated articles within 45 days. 2 The duty of care specified in Article 41 paragraphs 1 and 2 applies mutatis mutandis. 3 The above provisions are without prejudice to the restrictions specified in the ORRChem.
