Art. 22 Principles
Imported products may be labelled as organic products if: a. they have been produced and prepared in accordance with rules which are equivalent to those laid down in Chapters 2, 2a and 3; b. their production is subject to an inspection and certification procedure which is equivalent to that laid down in Chapter 5 or corresponds to the inspection and certification procedure for groups of operators under Articles 34–36 of Regulation (EU) 2018/848.

Art. 23 List of countries
1 FOAG shall draw up a list of countries which are able to guarantee that their products meet the conditions laid down in Article 22. 2 The list shall indicate for each country the competent authority and the recognised certification bodies. The products, regions or operators may also be specified.

Art. 23a Recognition of certification bodies and inspection authorities not on the list of countries
1 Certification bodies and inspection authorities which, on the basis of the procedure laid down in Article 46 of Regulation (EU) 2018/848 have been recognised by the EU and are included in Annex II to Commission Implementing Regulation (EU) 2021/1378 as amended from time to time, are recognised. They may certify that the imported products meet the conditions laid down in Article 22 letter a. 2 FOAG may on request recognise further certification bodies and inspection authorities by including them on a list where they are not on the list in accordance with paragraph 1 and not included in the list referred to in Article 23, provided the certification bodies and inspection authorities can prove that the products in question meet the conditions laid down in Article 22. 3 Requests to be included on the list must be submitted to FOAG. Art. 24 Certificate of inspection
1 For imports, a certificate of inspection must be issued in the EU system for the electronic certification of the import of organic products (Traces) in accordance with Commission Delegated Regulation (EU) 2021/2306. Where a consignment is to be split into several batches before assessment, an extract from the certificate of inspection in Traces must be issued for each batch resulting from the split. 2 Switzerland uses the EU’s Traces information system. 3 FOAG shall grant certification bodies and operators in Switzerland access rights to Traces. It bases its decision on the check that the certification bodies have carried out in relation to the identity of the operators that they have under contract.
