Art. 36 Amendment of current legislation

The amendment of current legislation is regulated in the Annex.

Art. 37 Transitional period for the use of antibiotic resistance genes

Resistance genes to antibiotics used in human and veterinary medicine may be used in field trials until 31 December 2008.

Art. 37a Transitional period for putting genetically modified organisms into circulation

1 No authorisations may be granted until 31 December 2021 for putting into circulation genetically modified plants and parts of plants, genetically modified seeds and other plant propagation material and genetically modified animals for agricultural, horticultural or silvicultural purposes. 2 The Federal Council shall submit draft legislation to the Federal Assembly by mid-2024 at the latest on a risk-based authorisation regime for plants, parts of plants, seeds and other plant propagation material for agricultural, horticultural or silvicultural purposes which have been cultivated using methods of new cultivation technologies, into which no transgenic genetic material has been inserted and which have a proven added value for agriculture, the environment or consumers compared with conventional cultivation methods.

Art. 38 Referendum and commencement
